Terms and Conditions

Momentum Network ยท 5201 Waterford Dr, Miami, FL 33126

Please Read Carefully

By accessing the website or creating an account, you agree to these Terms and represent that you have the legal capacity to enter into a binding agreement.

Acceptance and Eligibility

By accessing the website or creating an account, the user agrees to these Terms and represents that the user has legal capacity to enter into a binding agreement. Additional eligibility requirements may apply to particular memberships, services, or the Affiliate Program.

Accounts and Credentials

Users are responsible for providing accurate information, protecting credentials, and promptly reporting unauthorized access. Credentials for credit monitoring, payment accounts, or sensitive financial services must be submitted only through the designated secure portals, not through public website forms or ordinary email.

Acceptable Use

Users may not misuse the website, interfere with security, submit false information, impersonate another person, scrape protected content, upload malware, make unlawful claims, or use Momentum or MAC materials without authorization.

Provider Roles

Momentum Network provides Optima Membership, education, financial-wellness tools, member resources, support, and the Affiliate Program. Momentum American Credit independently provides the approved Credit Optimization services identified in its service agreement. Smart Credit is an independent third-party monitoring provider.

Payments and Renewal

The selected plan, exact initial charge, recurring amount, billing frequency, collecting legal entity, statement descriptor, included services, and any third-party charges must be presented before payment. Memberships renew automatically only after the user provides express informed consent.

Cancellation and Refunds

Users may cancel future renewals through the published cancellation method. Cancellation timing, access through the paid period, refunds, and any non-waivable statutory rights are governed by the applicable plan and service-specific agreement.

Educational Scope and No Guarantees

Educational tools and information are not legal, tax, investment, lending, or individualized financial advice. Credit outcomes, product approvals, commission eligibility, and income are not guaranteed.

Third-Party Services

Third-party providers have separate terms, privacy practices, eligibility requirements, availability, and charges. Momentum and MAC do not control third-party decisions, credit bureaus, creditors, furnishers, lenders, or scoring models.

Intellectual Property

Website content, trademarks, software, training, and approved promotional materials remain the property of their respective owners. Affiliates receive only the limited permission stated in current program documents.

Conflicts and Updates

If these general Terms conflict with a service-specific agreement, Affiliate Agreement, Compensation Plan, or legally required disclosure, the specific document controls for that subject. Material changes will be communicated as required by law; continued use will not replace a new consent when law requires one.

Contact and Governing Law

Governing-law and dispute-resolution provisions must match the final approved contracts and cannot waive non-waivable federal or state rights.

MOMENTUM NETWORK FINANCIAL LLC

Optima Membership Client Terms and Conditions

Terms for Optima Individual and Optima Family customer memberships

Effective date: August 28, 2026

Please read these Terms carefully.

These Terms govern your paid Optima membership with Momentum Network Financial LLC. They explain the membership benefits, immediate and recurring charges, cancellation process, refund rules, use of third-party providers, and important limits on credit-related services. State-specific or federally required credit-services disclosures and cancellation notices are provided separately when applicable and control if they grant you greater rights.

Merchant of record

Momentum Network Financial LLC; this is the name that may appear on your billing statement

Agreement and order of documents

These Terms, the information and pricing shown during checkout (the "Order"), the Privacy Policy, and any documents you separately sign for regulated credit-related services form the agreement between you and Momentum. You accept the agreement by checking the acceptance box, signing electronically, or completing enrollment. If an Order conflicts with these Terms, the Order controls only as to the selected plan, price, and billing date. A mandatory consumer disclosure or state-specific addendum controls to the extent it gives you greater rights or cannot legally be waived.

These Client Terms apply to customers. They do not enroll you in any separate independent marketing, referral, affiliate, or business-opportunity program. Any such program is governed by its own written agreement, compensation terms, and income disclosure. A customer membership is not an investment, employment relationship, franchise, or promise of earnings.

Eligibility and account information

You must be at least 18 years old, legally capable of entering a contract, and located where the selected services may lawfully be offered. You agree to provide accurate, current, and complete information; keep it updated; protect your credentials; and notify us promptly of suspected unauthorized access. We may require identity verification before activating sensitive or credit-related features.

Optima membership plans

Both plans provide the same categories of membership benefits. The only plan difference is the number of adults who may receive the benefits under the membership.

Plan

Covered adults

Initial charge

Recurring charge

Optima Individual

1

$249.99

$99.99 monthly

Optima Family

Up to 2

$299.99

$149.99 monthly

The initial charge is processed immediately when the primary purchaser completes online enrollment. The recurring charge is processed monthly on the billing date disclosed at checkout until the membership is canceled. Applicable taxes, if any, will be disclosed before they are charged.

Membership benefits

During an active paid period, the Optima membership may include the following bundled financial-wellness benefits, subject to eligibility, onboarding, provider availability, and applicable law:

  • Financial education and resources, including educational content designed to help members understand credit, budgeting, debt, savings, and personal finance.
  • Planning tools, which may include My Budget, a net-worth tracker, debt-payoff planning, and DreamSaver goal tools.
  • Member platform and secure storage, including a personal back office, member resources, support, and Momentum Locker functionality.
  • Credit-focused education and support, which may include a credit analysis, an optimization plan, a credit-builder blueprint, debt-relief guidance, and educational assistance supported by Synthia or similar technology.
  • Credit-related fulfillment, where elected and legally available, through Momentum and authorized service providers after required documents, authorizations, and cancellation periods are complete.
  • Third-party partner access or offers, such as access to SmartCredit credit-monitoring options, which are governed by the third party's own terms, privacy policy, eligibility requirements, and any separately disclosed charges.

Benefits are intended to work together as a financial-wellness membership. The initial and recurring membership charges are not represented as payment solely for credit repair. We may improve or replace a feature with a materially comparable feature, but we will provide advance notice before a material reduction in core paid benefits or an increase in recurring price.

Activation and timing of services

Enrollment activates the primary purchaser's membership and access to available platform features and resources. Certain benefits require additional steps, including identity verification, uploading documents, linking or purchasing a third-party monitoring product, completing questionnaires, or signing separate authorizations. Delays caused by incomplete onboarding, unavailable credit reports, fraud alerts, security freezes, or third-party systems do not change the recurring billing date unless we agree otherwise in writing.

Credit-related work will not begin until any legally required cancellation period has expired unless the law expressly permits an earlier start at your request, and until we have received required documents and authorizations. Where law prohibits advance payment for credit-repair services, Momentum will not treat a membership charge as an advance payment earned for unperformed credit-repair services. Any separately priced regulated service will follow the payment timing required by law and its separate written agreement.

Optima Family membership

The primary purchaser completes enrollment, pays the plan charges, and may later invite one additional adult through the member platform. The second adult is not required to purchase a separate membership, but must create or verify their own profile and separately sign all privacy notices, credit-file rights disclosures, service authorizations, and other documents required for services involving that person's information. We will not access, use, or submit the second adult's credit information before receiving that adult's valid authorization.

Each adult retains rights in their own personal and credit information. We do not automatically disclose one adult's credit report, documents, messages, or case details to the other adult. The primary purchaser remains responsible for plan charges and account administration. The plan covers no more than two adults at a time.

Automatic renewal and payment authorization

By completing checkout, you authorize Momentum and its payment processors to charge the payment method you provide for the disclosed initial charge and the plan's recurring monthly charge until cancellation. You also authorize us to use updated card information made available through your card network, where permitted. The billing statement may identify Momentum Network Financial LLC or a substantially similar descriptor.

You are responsible for maintaining a valid payment method. If a payment fails, we may retry the charge as permitted by card-network rules, notify you, and suspend access until the balance is paid. We will not add a late fee unless it was clearly disclosed and lawful. We will provide advance notice of a recurring-price increase and obtain any additional consent required by law before the new price is charged.

Cancellation rights

Statutory cancellation period

If a federal or state law gives you a right to cancel a credit-services contract, the separate contract and Notice of Cancellation provided to you will explain the deadline and permitted delivery methods. For a Florida credit-services contract, the cancellation period is five business days after signing, without penalty or obligation, or any longer period required by law. A valid statutory cancellation will receive the refund and other remedies required by law. You may use any method permitted in the statutory notice; email to [email protected] is an additional option and is not intended to restrict a legally permitted method.

Ordinary membership cancellation after the statutory period

Except for a statutory cancellation or another cancellation method required by law, ordinary membership cancellation must be requested by email to [email protected]. Include the primary purchaser's full name, enrollment email, and membership identifier if available. You may cancel at any time without a cancellation penalty. Cancellation takes effect at the end of the current paid billing period: access remains available until then, and the next recurring charge will not be processed if the request is received before that charge is submitted for processing.

If a request arrives after a recurring charge has already been submitted, the cancellation will prevent the following renewal. We will confirm the cancellation by email. You should retain that confirmation.

Refund policy

Initial charge. The initial membership charge is refundable during any applicable statutory cancellation period. After that period ends, it is nonrefundable except when required by law or when Momentum fails to provide the paid membership access and does not cure the failure within a reasonable time.

Recurring charges. A recurring charge is nonrefundable once processed, except when required by law or when Momentum received a valid cancellation request before the charge was submitted but the charge was nevertheless processed.

No prorated refunds. Canceling after the statutory period does not create a partial or prorated refund for the remainder of the current paid period; access continues through that period.

Third-party charges. Charges made directly by SmartCredit or another independent provider are subject to that provider's cancellation and refund terms. Momentum cannot cancel or refund a charge it did not process.

Credit-related services and consumer rights

No guarantee of results.

Momentum does not guarantee a particular credit score, deletion, approval, interest rate, debt reduction, financing outcome, completion date, or any other result. Accurate, current, and verifiable negative information generally cannot lawfully be removed merely because it is unfavorable.

You have the right to dispute inaccurate or incomplete credit information yourself without paying a credit-repair organization. You may contact the nationwide consumer reporting agencies and information furnishers directly. If you elect credit-related assistance, you will receive and sign any separate Credit Services Agreement, Consumer Credit File Rights disclosure, authorization, and Notice of Cancellation required for your location before regulated services begin.

Momentum does not provide legal representation, tax advice, lending, or a promise of credit approval. Educational guidance is general and does not replace advice from an attorney, tax professional, licensed financial professional, or other qualified adviser who understands your circumstances.

Your responsibilities

  • Provide truthful information and only documents you are legally authorized to provide.
  • Review all credit reports, correspondence, and proposed actions for accuracy; promptly tell us if anything is incorrect.
  • Upload or forward bureau, creditor, collector, or furnisher responses promptly when needed for continued service.
  • Do not ask us to dispute information you know is accurate, create a new credit identity, misstate facts, submit false identity-theft reports, or engage in fraud.
  • Continue paying lawful obligations and monitoring accounts; membership does not stop collection activity, interest, late fees, litigation, or reporting.
  • Maintain access to your enrollment email and keep your account and payment information current.

Third-party service providers

Momentum is the contracting party, membership provider, and merchant of record. We may use authorized third parties to perform portions of the services. Momentum American Credit ("MAC") may provide credit-focused fulfillment on Momentum's behalf. We may also use payment processors, membership and case-management platforms, cloud and communications providers, security vendors, postal services, and other operational providers. Momentum pays its service providers under its own arrangements; your payment obligation is to Momentum unless checkout clearly identifies a separate third-party purchase.

SmartCredit and other separately selected monitoring or identity products are independent services. Their terms, privacy practices, eligibility rules, trial periods, prices, renewal terms, and cancellation methods apply to their accounts. A link, integration, or partner relationship does not make Momentum responsible for a third party's platform, data, or separately billed service, except to the extent required by law.

Communications and electronic records

You consent to receive agreements, notices, receipts, membership messages, and service communications electronically at the email address you provide. After enrollment, we may also communicate by telephone, SMS, or WhatsApp when you provide the relevant contact information and consent. Consent to marketing messages is not a condition of purchase. You may opt out of marketing texts by replying STOP, but we may continue nonmarketing communications needed to administer your account or comply with law.

You must have internet access and a device capable of viewing and retaining PDF or web documents. You may request a paper copy by emailing [email protected]. Tell us promptly if your email address changes.

Privacy and account security

Our Privacy Policy explains how Momentum collects, uses, retains, and discloses personal information. You authorize the information practices necessary to provide your elected services, subject to the Privacy Policy and any separate credit-file authorization. Do not share your password or allow unauthorized access to your member platform. Notify us promptly at [email protected] if you suspect a compromise.

Acceptable use and ownership

The membership and platform are for personal, lawful use by the covered adult or adults. You may not resell access; impersonate another person; interfere with security; scrape, reverse engineer, or automate access without written permission; upload malware; or use the services to violate privacy, credit-reporting, identity-theft, financial-services, or other laws. We and our licensors retain ownership of platform software, designs, educational materials, trademarks, and other content. We give you a limited, revocable, nontransferable license to use member content for your personal purposes during an active membership.

You retain ownership of documents and information you provide. You grant Momentum and its authorized providers permission to host, reproduce, transmit, and use them only as reasonably necessary to provide services, administer the account, protect users, and comply with law.

Suspension and termination

We may suspend or terminate access for nonpayment, fraud, unlawful conduct, security risk, material breach, or when we cannot lawfully continue a service. When reasonably possible, we will provide notice and an opportunity to cure. If we terminate an active paid membership for convenience and not because of your breach, we will provide a prorated refund for the unused portion of the paid period. Termination does not eliminate accrued payment obligations, required record retention, or provisions that by their nature survive.

Service limitations and liability

Services depend on information from you and third parties, including consumer reporting agencies, furnishers, creditors, monitoring providers, and technology platforms. We do not control their response times, decisions, outages, or data accuracy. To the fullest extent permitted by law, the services are provided on an "as available" basis without implied warranties that can legally be disclaimed.

To the fullest extent permitted by law, neither party will be liable for indirect, incidental, special, punitive, or consequential damages that were not reasonably foreseeable. Momentum's aggregate liability arising from the membership will not exceed the membership charges you paid to Momentum during the six months before the event giving rise to the claim. These limitations do not apply to refunds expressly owed, gross negligence, willful misconduct, personal injury, a party's misuse of confidential information, or any statutory consumer right or remedy that cannot lawfully be limited.

Questions, payment disputes, and governing law

Contact [email protected] first if you believe a charge or service is incorrect so we can investigate promptly. This request does not waive any right to contact your card issuer, regulator, consumer reporting agency, or court.

Florida law governs the agreement, without regard to conflict-of-law rules, except that mandatory consumer-protection law of your state of residence continues to apply. Any court proceeding that may lawfully be required to occur in Florida must be brought in a state or federal court located in Miami-Dade County, Florida. Nothing in this paragraph waives a small-claims option, statutory venue, or other non-waivable consumer right. These Terms do not require arbitration or waive participation in a class action.

Changes to these Terms

We may update these Terms prospectively to reflect changes in services, law, security practices, or operations. We will post the updated version with a new effective date. For a material change affecting price, automatic renewal, cancellation, data use, or a core paid benefit, we will provide advance notice and obtain additional consent when required by law. Changes do not reduce rights that accrued before the new effective date.

General terms

If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not assign the membership without our written consent; we may assign the agreement as part of a merger, financing, reorganization, or sale, subject to continued protection of your rights and personal information. The agreement is the entire agreement about the customer membership, excluding separately executed credit-services, third-party, or independent-marketing documents. Headings are for convenience only.
